Most frequently found and sanctioned labour law violations in 2017

In 2017, the inspectors of the Labour Inspectorate of the Republic of Slovenia (IRSD) carried out approximately 14,500 inspections and established in total more than 29,000 violations, for which they imposed the fines in the amount of more than EUR 3 million, a little bit less than in 2016.

The most frequent violation in 2017 was a failure to pay or delay in payment of the wages (violations concerning the payday are predominant), holiday allowance and other work-related allowances. In particular, it is problematic that despite tighter control in this area many employers still fail to pay the wages on time, and many do not pay the holiday allowance at all. In practice, it is often the case that employers fail to give the payslips to workers, even though they have an obligation to do so. There are frequent violations concerning employment in a broader sense (for example, concluding fixed-term employment contracts, part-time employment contracts even though the worker works full-time), violations regarding the work and social security records as well as violations concerning working-hours and ensuring rest periods.
As far as violations regarding the occupational health and safety are concerned, IRSD emphases, in particular, that the measures are not being implemented in practice or that their implementation is insufficient. At the forefront are still violations concerning the risk assessment (especially in relation to the incorrect content and revision of the statement of safety with risk assessment), providing workers with healthcare and the training regarding safety at work. 
IRSD also points out numerous violations arising from the concealed employment relationship and violations of the prohibition of concluding the civil law contracts in breach of the Employment Relationships Act (ZDR-1). In 2018, the Inspectorate will pay even more attention than in the previous years to this pressing problem of the precarious forms of work, in addition to carrying out the in-depth control of the payment of wages, including the providing workers with the payslips no later than the payday. IRSD’s action should, therefore, contribute to better employer’s discipline when concluding and performing employment contracts in accordance with the Employment Relationships Act (ZDR-1). 
IRSD has also been carrying out various targeted controls this year; its attention has been directed to the payment of wages as well as occupational health and safety in the construction sector, cleaning services sector and traffic sector.
