Which traders may open on Sundays and non-working days?

The Act Amending the Trade Act (Official Gazette of the Republic of Slovenia, 139/2020) stipulates that a trader may not open shop on Sundays and non-working days established by law. However, this does not apply to shops with sales areas of up to 200 square meters at gas stations, border crossings, ports (intended for public transport), airports, railway and bus stations and hospitals.

Traders may also open shop on Sundays and non-working days where goods are sold (i) in shops with sales areas of up to 200 square meters and if (ii) work in shops on those days is performed by an authorized representative or procurator of the company or a student or a person entitled to work temporarily or occasionally under the law governing the labor market, but provided that the authorized representative or procurator of the company is also present.

The amendments to the law refer exclusively to sales facilities or shops (if a sales area is open within the shop, where the goods are sold directly, this area is also considered a sales area or a shop). The Trade Act however differentiates between working in (i) shops and (ii) mobile shops, via stalls, via a vending machine, door-to-door, remotely and at a market. Working on Sundays and non-working days in mobile shops, at stalls, via a vending machine, door-to-door, remotely and at a market is still permitted.

A trader who wishes to operate a stall must (also) register for activity number 47.890 of the Standard Classification of Activities: “Retail sale via stalls and markets of other goods”.
