Busy month on the collective agreement front
Three new collective agreements were published in October, these being the Collective agreement for the timber industry (CTI), Collective agreement for real estate activities (CRE) and Collective agreement for the agriculture and food industry (CAFI).
The wording of the collective agreements can be found in the Official Gazette of Republic of Slovenia no. 67/16 . The CRE will replace the existing collective agreement from 1998. The new CRE has been concluded for an open-ended duration and will be in effective as of 1 January 2017. The CAFI and CTI entered into force on 1 November 2016 and have both been concluded for a fixed duration. The CTI has been concluded for a period until 31 October 2017, whereas the CAFI has been concluded for a period of two years.
The main achievement of the concluded CAFI represents the 0.9 percent increase in gross monthly wage, flexibility in working hours, additional vacation days and other rights, which is an improvement on the minimum provided by law. The main achievement of the CRE is the harmonization of the CRE with current legislation, as well as of the tariff part, providing for regulation of all payments to employees.
The last issue of Legal BUZZ for the year 2016 opens with news on Rubik’s Cube failure to register the shape of the cube as a 3D European Union trademark. Further on, we focus on two rulings of the Supreme Court regarding the protection of consumers’ rights, namely the enforcement of liquidated damages in a leasing contract and the seller’s liability in cases when the parties agreed on the use of the seen-bought clause in the sales agreement. We wrap up this issue with news regarding three new collective agreements, published in October 2017.
